The United States Government has outlined two major family-based immigrant visa categories for foreigners seeking permanent residence through qualifying relatives: Immediate Relative visas and Family Preference visas. Immediate Relative visas are available to certain close relatives of US citizens, including spouses, unmarried children under 21 and parents of citizens aged 21 or older, while the number issued each year is not subject to a numerical cap.
The Family Preference category covers other qualifying family relationships involving US citizens and lawful permanent residents, including unmarried adult children, married children and siblings of US citizens, as well as spouses and unmarried children of green-card holders. Unlike Immediate Relative visas, Family Preference visas are subject to annual numerical limits, meaning applicants may face waiting periods before an immigrant visa becomes available.
Applicants must still meet the relevant eligibility requirements and complete the required immigration process before obtaining permanent residence. The US guidance is aimed at helping prospective immigrants understand which family-sponsored pathway applies to their circumstances and the differences between the two categories.
