\n\nThe Nigerian Army has continued to defy multiple court rulings ordering the reinstatement of 38 officers who were compulsorily retired in 2016, raising serious concerns about compliance with judicial authority. The officers, ranging from major generals to lieutenant colonels, were dismissed on allegations of misconduct, including partisanship during the 2015 elections and issues related to arms procurement. 
However, several of the affected officers challenged their dismissal in court and secured favourable judgments between 2018 and 2021. Courts, including the National Industrial Court and the Court of Appeal, declared their retirements illegal, unconstitutional, and null and void, ordering their immediate reinstatement with full benefits, promotions, and entitlements. 
Despite these rulings, the army has failed to implement the judgments, with reports indicating that even appeals and statutory petitions by the officers were ignored. In some cases, the legally required response to appeals within 30 days was not provided, further deepening claims of procedural violations and denial of fair hearing. 
Legal experts, including senior lawyer Femi Falana, have criticised the continued non-compliance, urging the Federal Government to intervene. He argued that ignoring valid court orders undermines the rule of law and could damage morale within the military. The matter has also drawn attention from the National Assembly, which reportedly supported the officers’ reinstatement, yet the situation remains unresolved nearly a decade later.
